Model Code of Ethics and Official Behavior of Civil Servants of the Russian Federation and Municipal Employees
This Code of Ethics has been approved by the decision of the Presidium of the Council under Preresident of the Russian Federation on combating corruption of December 23, 2010 by the protocol No. 21. The full text of the document is also relevant in 2018.
Consists of four sections:
- Section I. General Provisions( paragraphs 1-9).
- Section II.Basic principles and rules of official conduct of state( municipal) employees( cl. 10-24).
- Section III.Recommended ethical rules of official conduct of state( municipal) employees( clauses 25-28).

General
- The Model Code of Ethics and Official Conduct of Civil Servants of the Russian Federation and Municipal Officers( hereinafter referred to as the Model Code) has been developed in accordance with the provisions of the Constitution of the Russian Federation, the International Code of Conduct for Public Officials( UN General Assembly Resolution 51/59 of December 12, 1996), Model Code of Conduct for Civil Servants( annex to the Recommendation of the Committee of Ministers of the Council of Europe of 11 May 2000 NR( 2000) 10 on codes of conduct for public servants),Model Law "On the Basics of Municipal Service"( adopted at the 19th Plenary Session of the Interparliamentary Assembly of Member Nations of the Commonwealth of Independent States( Decree No. 19-10 of March 26, 2002), Federal Laws of December 25, 2008 N 273-FZ"On Counteracting Corruption", May 27, 2003, No. 58-FZ "On the Civil Service System of the Russian Federation", dated March 2, 2007, No. 25-FZ "On Municipal Service in the Russian Federation", other federal laws containing restrictions, bans and duties for civil servants RosIisko Federation and municipal employees, the Decree of the President of the Russian Federation on August 12, 2002 N 885 "On approval of the general principles of official conduct of civil servants" and other normative legal acts of the Russian Federation, as well as based on the universally accepted moral principles and norms of the Russian society and the state.
- The Model Code is the basis for the development by the relevant state bodies and local self-government bodies of codes of ethics and official conduct of civil servants of the Russian Federation and municipal employees( hereinafter - state( municipal) employees).
- The Model Code is a set of general principles of professional professional ethics and basic rules of official conduct, which should guide state( municipal) employees regardless of their replaced position.
- A citizen of the Russian Federation who enters the public service of the Russian Federation or the municipal service( hereinafter referred to as the state and municipal service) is obliged to familiarize himself with the provisions of the Model Code and observe them in the course of his official activities.
- Each state( municipal) employee must take all necessary measures to comply with the provisions of the Model Code, and every citizen of the Russian Federation has the right to expect from the state( municipal) employee conduct in relations with him in accordance with the provisions of the Model Code.
- The purpose of the Model Code is to establish ethical norms and rules of official conduct of state( municipal) employees for the decent performance of their professional activities, as well as to promote the authority of state( municipal) employees, citizens' trust in state bodies and local self-government bodies and ensuring uniform standards of conductstate( municipal) employees.
- The Model Code is designed to improve the efficiency of performance by state( municipal) employees of their official duties.
- The Model Code serves as the basis for the formation of proper morals in the sphere of state and municipal service, respectful attitude to state and municipal service in the public consciousness, and also acts as an institution of public consciousness and morality of state( municipal) employees, their self-control.
- Knowledge of and compliance with the provisions of the Model Code by state( municipal) employees is one of the criteria for assessing the quality of their professional activities and performance.
Basic principles and rules of official conduct of state( municipal) employees
- The basic principles of official conduct of state( municipal) employees are the basis for the conduct of citizens of the Russian Federation in connection with their location in the state and municipal service.
- State( municipal) employees, conscious of responsibility to the state, society and citizens, are called upon:
a) to perform official duties in good faith and on a high professional level in order to ensure the effective operation of state bodies and local self-government bodies;
B) proceed from the fact that the recognition, observance and protection of human and citizen's rights and freedoms determine the basic meaning and content of the activities of both state and local government bodies and state( municipal) employees;C) carry out its activities within the powers of the relevant state body and local government;d) not to give preference to any professional or social groups and organizations, be independent of the influence of individual citizens, professional or social groups and organizations;
e) exclude actions related to the influence of any personal, property( financial) and other interests that interfere with the conscientious performance of their official duties;
e) notify the representative of the employer( s), the prosecutor's office or other state bodies or local authorities of all cases of applying to any state( municipal) employee of any persons for the purpose of inciting to commit corrupt offenses;G) comply with the restrictions and prohibitions established by federal laws, perform duties related to the passage of state and municipal service;H) observe an impartiality that excludes the possibility of influencing the performance of their decisions by political parties and public associations;
i) comply with the norms of official, professional ethics and rules of business conduct;
j) to show correctness and care in dealing with citizens and officials;
l) to show tolerance and respect for the customs and traditions of the peoples of Russia and other states, take into account the cultural and other characteristics of various ethnic, social groups and faiths, promote interethnic and inter-religious harmony;
m) refrain from behavior that could cause doubt in the conscientious performance of official duties by the state( municipal) employees, as well as avoid conflict situations that could damage its reputation or the authority of a state body or local government;
n) take measures provided for by the legislation of the Russian Federation to prevent the emergence of a conflict of interest and the settlement of any conflict of interest cases that have arisen;
o) not use the official position to influence the activities of state bodies, local governments, organizations, officials, state( municipal) employees and citizens in resolving personal matters;
p) refrain from public statements, judgments and assessments regarding the activities of a state body or local government or its head, if this is not part of the official duties of a state( municipal) employee;
p) observe the rules of public statements and the provision of official information established in the state body or local government;
c) Respectfully respect the activities of representatives of the mass media in informing the public about the work of a state body or a local government body, and also assist in obtaining reliable information in accordance with the established procedure;
t) refrain from publicly speaking, including in the mass media, from indicating the value of goods, works, services and other objects of civil rights on the territory of the Russian Federation in foreign currency( conditional, monetary units), amounts of transactions between residents of the Russian Federation,indicators of budgets of all levels of the budgetary system of the Russian Federation, the size of state and municipal borrowings, state and municipal debt, except for cases when it is necessary to accuratelytransmission of information either provided by the legislation of the Russian Federation, international treaties of the Russian Federation, business customs;
y) constantly strive to ensure the most efficient disposal of resources that are in its area of responsibility.
- State( municipal) employees are obliged to observe the Constitution of the Russian Federation, federal constitutional and federal laws, and other normative legal acts of the Russian Federation.
- State( municipal) employees in their activities should not allow violation of laws and other regulatory legal acts, based on political, economic feasibility or for other reasons.
- State( municipal) employees are obliged to counteract manifestations of corruption and take measures to prevent it in the order established by the legislation of the Russian Federation.
- State( municipal) employees in the performance of their official duties should not allow personal interest, which leads or may lead to conflict of interest.
When appointing a state or municipal service and performing job duties, a state( municipal) employee is required to declare the existence or possibility of having a personal interest in him that affects or may affect the proper performance of his official duties.
- A state( municipal) employee is required to submit information on income, property and property obligations of his and his family members in accordance with the legislation of the Russian Federation.
- The state( municipal) employee is obliged to notify the representative of the employer, the prosecutor's office of the Russian Federation or other state bodies of all cases of applying to him any person with a view to inciting him to commit corrupt offenses.
Notification of facts of treatment for the purpose of inciting to commit corrupt offenses, except for cases when, according to these facts, an audit is carried out or is being conducted, it is the official duty of a state( municipal) employee.
- It is prohibited for a state( municipal) employee to receive remuneration from individuals and legal entities( gifts, monetary compensation, loans, material services, fees for entertainment, rest, use of transport and other fees) in connection with the performance of his official duties. Gifts received by the state( municipal) employees in connection with protocol activities, with official business trips and with other official events, are recognized respectively by federal property, property of the subject of the Russian Federation, local government and transferred by the state( municipal) employees to the state body or authoritylocal government in which he replaces the post of state or municipal service, with the exception of cases established bythe legislation of the Russian Federation.
- A state( municipal) employee can process and transfer service information while observing the norms and requirements in force in a state body or local government body, adopted in accordance with the legislation of the Russian Federation.
- The state( municipal) employee is obliged to take appropriate measures to ensure the security and confidentiality of information for which he is responsible for unauthorized disclosure or( and) which became known to him in connection with the performance of his official duties.
- The state( municipal) employee, who has organizational and administrative powers in relation to other state( municipal) employees, should be for them a model of professionalism, impeccable reputation, promote formation in the state body or its subdivision( local government or its subdivision) favorable foreffective work of the moral and psychological climate.
- A state( municipal) employee with organizational and administrative powers over other state( municipal) employees is called upon:
a) to take measures to prevent and resolve conflicts of interest;B) take measures to prevent corruption;
c) not allow cases of coercion of state( municipal) employees to participate in the activities of political parties and public associations.
- A state( municipal) employee with organizational and managerial powers in relation to other state( municipal) employees must take measures to ensure that subordinate state( municipal) employees do not allow corruptly dangerous behavior, by their personal behavior, set an example of honesty, impartialityand justice.
- The state( municipal) employee, who has organizational and administrative powers in relation to other state( municipal) employees, is liable in accordance with the legislation of the Russian Federation for acts or omissions of subordinate employees violating the principles of ethics and the rules of official conduct,measures to prevent such acts or omissions.
Recommended Ethical Rules for Official Behavior of State( Municipal) Employees
- In the official conduct of a state( municipal) employee, it is necessary to proceed from the constitutional provisions that a person, his rights and freedoms are the highest value and every citizen has the right to privacy, personal andfamily secret, protection of honor, dignity, his good name.
- In official conduct, a state( municipal) employee refrains from:
a) any kind of statements and actions of a discriminatory nature on grounds of sex, age, race, nationality, language, citizenship, social, property or marital status, political or religious preferences;B) rudeness, displays of disdainful tone, arrogance, prejudiced remarks, presentation of unlawful, undeserved accusations;C) threats, offensive language or remarks, actions that interfere with normal communication or provoke unlawful behavior;
d) smoking during official meetings, conversations, other official communication with citizens.
- State( municipal) employees are called upon to contribute to their official behavior by establishing in the team of business relationships and constructive cooperation with each other.
State( municipal) employees should be polite, friendly, correct, attentive and tolerant in communicating with citizens and colleagues.
- The appearance of the state( municipal) employee in the performance of his official duties, depending on the conditions of service and the format of the official event, should promote respectful attitude of citizens to state bodies and local self-government bodies, correspond to the generally accepted business style, which is distinguished by officiality, restraint, traditionality, accuracy.
Responsibility for violation of the provisions of the Model Code
- Violation of the provisions of the Model Code by the state( municipal) employees is morally condemned at a meeting of the relevant commission on compliance with the requirements for the conduct of state( municipal) employees and the conflict of interests formed in accordance with the Decree of the President of the Russian Federation of 1July 2010 N 821 "On commissions to comply with the requirements for the conduct of official behavior of federal civil servants and the settlementconflict of interests ", and in cases provided for by federal laws, a violation of the provisions of the Model Code entails application of measures of legal responsibility to the state( municipal) employee.
Observance by the state( municipal) employees of the provisions of the Model Code is taken into account in the performance of attestations, the formation of a personnel reserve for promotion to higher positions, as well as disciplinary sanctions.
